Child Abuse Laws in Indiana
Juvenile Code:
.Encourages effective Reporting of Suspected or Known Incidents of Child Abuse or Neglect
. Provides each County with an Effective Child Protection Services
. Provides Children and Families with Rehabilitative Services
. Established a Centralized Statewide Child Abuse Registry and an Automated Child Protection
Definitions:
Child Abuse or Neglect refers to a Child who is alleged to be in need of Services (CHINS).
The Complete Text of the CHINS law can be found at http://pcain.org/indiana_laws.asp . (IC 31-34-1) A Child is in need of Services if before the Child's 18th Birthday.
. The Child's Physical or mental Health Conditon is seriously impaired or seriously endangered
as a result of the Inability, Refusal, or Neglect of the Child's Parent/Guardian/Custodian to supply the Child with Necessary
Food, Clothing, Shelter, Medical Care, Education, or Supervision.
. The Child's Physical or Mental Health is seriously endangered due to Injury by the Act or
Omission of the Child's Parent/Guardian/Custodian.
An Omission is an Occurrence in which the Parent/Guardian/Custodian allowed that Person's
Child to receive an Injury the Parent/Guardian/Custodian had a reasonable opportunity to prevent or mitigate
. The Child is the Victim of a Sex Offense under the Criminal Citations incorporated into
the CHINS Definition.
. The Child's Parent/Guardian/Custodian allows the Child to participate in an Obscene Performance
. The Child's Parent/Guardian/Custodian allows the Child to commit a Sex Offense
And needs Care, Treatment, or Rehabilitation that the Child is not currently receiving and
that is unlikely to be provided or accepted without the Coercive Intervention of the Court.
This Definition includes a Child with a Disability that is deprived of:
. Nutrition necessary to sustain Life
. Medical or Surgical Intervention necessary to remedy or ameliovate a Life Threatening Medical
Conditon if the Nutrition or Medical or Surgical Intervention is generally provided to similarly situated Children with or
without Disabilities.
Religious Beliefs/Provision of Medical Treatment:
When a Paren/Guardian/Custodian fails to provide specific Medical Treatment for a Child because
of the Legitiimate and Genuine Practice of the Parent/Guardian/Custodian's Religious Beliefs, a Refutable Presumption arises
that the Child is not a Child in need of Services because of such Failure. However, this Presumption does not prevent a Juvenile
Court from Ordering when the Health of the Child requires, Medical Services from a Physician Licensed to Practice Medicine
in Indiana. The Presumption does not apply to Situations in which the Life or Health of a Child is in serious danger.
Use of Corporal Punishment:
Nothing in the Juvenile Code liimits the Right of a Person to use Reasonable Corporal Punishment
when Disciplining a Child if the Person is the Parent/Guardian/Custodian of the Child. In addition, nothing in this Chapter
liimits the Lawful Practice or Teaching of Religious Beliefs.
Reporting:
Any Individual who has reason to believe that a Child is a Victim of Child Abuse or Neglect
must make a Report. In Agencies in which there are Established Reporting Protocols the Report may be made to the Individual
in Charge or another Designated Agent, who also becomes responsible to Report or cause a Report to be made. This does not
relieve Individuals who make a Report to another Staff Person of their own obligation to Report directly to Child Protection
Services or Law Enforcement unless a Report has already been made by the Agency Liaison. Anonymous Reports are accepted.
Failure to make a Report can be a Class B Misdemeanor.
Immunity from Liability:
Any Person, other than the Accused, who Reports Child Abuse or Neglect or is involved in the
Investigation or Disposition of Child Abuse or Neglect Reports is Immune from Criminal or Civil Liability, unless the Person
acted maliciously or in Bad Faith.
Confidentiality:
All Reports made to CPS are Confidential and will only be released to CPS Workers, Police,
Prosecutors, Doctors, or other Authorized Personnel.
Child Protective Services:
Each County Office of Family and Children must establish a CPS, which will be the Primary
Agency responsible to Receive, Investigate or Arrange for Investigation and Coordinate the Investigation of all Reports of
Known or Suspected Child Abuse or Neglect.
CPS must:
. Provide Protective Services to prevent a Child's Exposure to further Incidents of Child
Abuse or Neglect. CPS must provide or arrange for, Coordinate and Monitor the Provision of Services to ensure the Safety of
Children. Reasonable Efforts must be made to prevent a Child's removal from the Home.
. Cooperate with and Seek and Receive Cooperation of Appropriate Public and Private Agencies
and Programs providing Services related to Prevention, Identification or Treatment of Child Abuse or Neglect.

Toddler Abandoned At Wal-Mart - FRANKFORT, INDIANA
A Mother abandoned her 2-year-old Boy in a Wal-Mart Store, leaving him with a Backpack full
of Toys, a Bottle and a note explaining why she could no longer care for him.
The Mother said in a Message written in Spanish that the Father had left her, according to
Frankfort Police.
The Note said the Boy's Name is Martin and that the Family moved from Guatemala about a year
ago, 6 News' Tanya Spencer reported.
"She has no Food, no Place to Live and no Job and her Son was starving," said Rosa Martinez,
who spoke with the Boys. "It was very upsetting, the Letter."
Store Employees brought the Boy into their Security Office after they found him wandering
around Friday afternoon.
Several attempts to locate his Mother over the loud-speaker were unsuccessful.
Martinez translated the Letter for Store Employees and called for the Mother in both English
and Spanish. She also tried to talk to the Boy, who wasn't crying but wouldn't say anything.
"I said, 'Where's Mommy?' in Spanish and he looked at me. He didn't move or nothing," Martinez
said.
"i've seen 2 year olds. They communicate and they're very active. he was not even moving,
not making Facial (Expression)--Nothing."
Child Protection Services is Caring for the Boy, and Police are trying to find the Mother.
Officers are watching Surveillance Camera Recordings and looking for Witnesses who saw the Woman at the Store.
Police said they aren't sure if the Message in the Note is true.
They are checking the Missing Persons Database.
"This Boy could actually be a missing Boy from another Jurisdiction," said Frankfort Police
Detective Jeff Ward. "Maybe this Person's not related to him at all."
Martinez, a Mother herself, said she hopes the Boy's Family Family, Past and Heritage won't
be lost forever."
"He won't remember anything because no Pictures, no Last name," Martinez said.
Frankfort's Hispanic Community is working closely with Police, but no one claimed to have
seen the Boy before.
Police said the Note indicated the mother was not from the area and did not plan to stay.

A Three-Month-Old Baby was found in the Trunk of a Wrecked Car early last Wednesday morning.
Sometime after Midnight, June 6, April Finch frantically called the Police and reported her Baby missing. Nearly an hour after
the initial Phone Call, the Baby was found unharmed and is listed in good condition. (Update: Finch told Police that she believed
her Child's Biological Father was involved with the disappearance.)
After a several day Investigation, it was revealed that April Finch, the "frantic Mother"
was the one who locked her Child in the Trunk of the Wrecked Vehicle behind a home near her Jasonville, Indiana Residence.
(Update: The Baby was locked inside the Trunk for what is being reported as nearly Four hours.)
Finch and her husband are new to the neighborhood and most neighbors didn't even know they
had Children. It is reported that Finch also has another Child, but was unharmed and not involved in this Incident. (Update:
Finch's husband reported to Police that he heard the Baby crying in the Trunk. Finch's husband is not the Biological Father
of the Baby in question.)
"I've never seen her outside with any Child, never seen any indication that she ever had any
Child," a neighbor said.
"I was in shock. I was very upset. Why would somebody do that to a Child, especially that
Age?" asked neighbor Bruce Cox.
April is Charged with Criminal Confinement involving a Vehicle - Class C Felony, Neglect of
a Dependent - Class A Felony, and False Informing - Class A Misdemeanor.
That's It? I would say ATTEMPTED MURDER!
